These Terms of Service ("Terms") govern your use of the CardBanter mobile application (the "App") provided by CardBanter ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 12 years of age and agree to comply with these Terms. If you do not agree, you must not use the App.

2. Description of Service

CardBanter is a pass-and-play party card game designed for social gatherings. Players take turns drawing cards that contain challenges, questions, voting prompts, mini-games, and special effects. The App is intended for entertainment purposes only.

3. In-App Purchases

The App offers additional card packs and AI-generated content through one-time in-app purchases. There are no subscriptions.

• Billing: All purchases are processed through Apple In-App Purchases (iOS) or Google Play Billing (Android). Payment is charged to your account at confirmation of purchase.
• Non-Consumable Purchases: Card deck packs (Premium, Friends, Chaos, Office, Couples, Local) are non-consumable purchases that can be restored on the same platform.
• Consumable Purchases: AI-generated card packs are consumable purchases. The generated cards are stored locally on your device and cannot be restored if you uninstall the App or switch devices.
• Refunds: Refund requests must be directed to Apple or Google, as all payments are processed through their respective stores.

4. AI-Generated Content

The App includes AI-powered card generation using OpenAI's services. Please note:

• Content Quality: AI-generated cards are designed to be fun, family-friendly, and suitable for ages 12+. While we provide detailed guidelines, we cannot guarantee every generated card will meet all expectations.
• No Personal Data: AI card generation does not send any personal information, player names, or device data to the AI service. Only card generation prompts are transmitted.
• Local Storage: AI-generated cards are stored only on your device and cannot be recovered after App deletion.
• Availability: AI card generation requires an active internet connection and depends on third-party API availability.

5. Content Guidelines

All card content (both built-in and AI-generated) is designed to be:

• Family-friendly and suitable for ages 12+
• Free of alcohol, drugs, violence, or sexual content
• Focused on social interaction, humor, and friendly competition

The App is not responsible for how players interpret or act upon card content during gameplay.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with the App's operation or security
• Use automated systems to access the App in a manner that exceeds reasonable use
• Attempt to bypass in-app purchase mechanisms

7. Intellectual Property

The App and all its content, features, and functionality (including but not limited to card content, design, code, graphics, and trademarks) are owned by CardBanter and are protected by intellectual property laws.

AI-generated cards purchased through the App are licensed for your personal use within the App only.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, CardBanter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data arising from:

• Your use of or inability to use the App
• Loss of AI-generated card content due to device changes or App deletion
• Content generated by the AI card generation feature
• Any third-party services integrated with the App

Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may stop using the App at any time by uninstalling it.

12. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CardBanter operates, without regard to conflict of law provisions.
